  • Demerit points: 3 points for first conviction, 6 points for second and subsequent convictions.
  • Fine range: $615 to $1,000 for first conviction, $615 to $2,000 for second conviction, and $615 to $3,000 for third and subsequent convictions (includes victim surcharge and court fees).
  • Mandatory licence suspension: 3 days for first conviction, 7 days for second conviction, 30 days for third and subsequent convictions.
  • Novice drivers (G1, G2, M1, M2): Same fines but NO demerit points. Instead, they face harsher suspensions: 30 days for first conviction, 90 days for second conviction, and licence cancellation with removal from Graduated Licensing System for third conviction.
  • Insurance consequences: Additionally, a single conviction can increase your car insurance premiums. Furthermore, the conviction stays on your record for 3 years, affecting your insurance rates throughout that period.
  • What counts as distracted driving: Holding or using a cell phone, smartphone, tablet, GPS, or any handheld device while driving (including at red lights or stopped in traffic). However, hands-free, voice-activated, or properly mounted devices are permitted.
